Terms of Service

1. Who These Terms Are Between
These Terms of Service govern the use of OurClass, including the service made available at ourclass.cloud. The service is operated by Sizorax Ltd (Company No. 16955799).
If you are using OurClass on behalf of a school, academy, trust, or other organisation, that organisation agrees to these terms through its authorised representatives and is responsible for ensuring its users comply with them.
2. The Service
OurClass provides teaching, assessment, reporting, scheduling, administrative, and AI-assisted learning workflows for UK schools and education providers. Features may vary by plan, role, age setting, governance controls, and product development stage.
3. Accounts and Access
- Accounts may be created directly by a customer organisation, through onboarding, or through administrator invitation.
- Customer organisations are responsible for approving who receives access to their tenant and for managing user roles appropriately.
- Users must keep credentials secure and must not share access in a way that bypasses role, safeguarding, or audit controls.
4. Acceptable Use
- OurClass must only be used for lawful educational, administrative, and related operational purposes.
- You must not use the service to upload unlawful content, bypass access controls, probe security, scrape data at scale, or interfere with other users or schools.
- You must not use AI features to generate harmful, discriminatory, or abusive content, or to make high-stakes decisions without appropriate human review.
5. AI Features
OurClass includes AI-assisted features for lesson drafting, assessment support, reporting, and learner-facing guidance. AI outputs may be inaccurate, incomplete, or unsuitable in some contexts, and teacher or administrator review remains important.
Learner-facing AI access may be restricted by school settings, moderation controls, safeguarding rules, and parental-consent requirements where applicable.
6. Data Protection and School Responsibilities
For core school-service processing, the relevant school, academy, or trust is normally the data controller and Sizorax Ltd acts as processor. The customer organisation is responsible for ensuring it has an appropriate lawful basis for the personal data it puts into OurClass and for handling data subject rights in line with its own obligations.
Where a Data Processing Agreement applies, it forms part of the contractual framework between the customer organisation and Sizorax Ltd. If there is a conflict between these terms and the DPA on a data-protection issue, the DPA should prevail for that issue.
7. Fees, Billing, and Plan Changes
Paid services, usage allowances, overages, renewals, and plan upgrades are governed by the pricing, billing, and ordering arrangements agreed with the customer organisation. Sizorax Ltd may update plans or product packaging from time to time, provided that any changes affecting active customers are handled through the relevant billing or contractual process.
8. Availability, Changes, and Support
Sizorax Ltd may improve, update, suspend, or retire parts of OurClass where reasonably necessary for security, legal compliance, supplier changes, or product development. We aim to avoid unnecessary disruption and to communicate material changes where appropriate.
9. Suspension and Termination
Sizorax Ltd may suspend or restrict access where reasonably necessary to protect the service, comply with law, respond to security or safeguarding concerns, or address a material breach of these terms. Customer organisations may also stop using the service in accordance with their commercial arrangement.
10. Intellectual Property
Sizorax Ltd and its licensors retain all intellectual property rights in OurClass, excluding customer data and materials owned by the customer or its users. These terms do not transfer ownership of the platform or its underlying software.
11. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, Sizorax Ltd's liability should be interpreted in conjunction with the applicable order, DPA, or other contractual documents agreed with the customer organisation.
12. Governing Law
These terms are governed by the laws of England and Wales, unless a mandatory law or a separately agreed contractual term requires otherwise.
